This will be a live offsite auction with live online bidding available. Online bidders must be

Absentee Bids: Bidding via telephone and/or on someone’s behalf must be approved by Dan
Clark Auctions at least 24 hours prior to the auction.

convenience, we recommend using your ATV, UTV or horse. Be respectful and close all

Property Possession: Due to a previous lease agreement, Buyer(s) will not be given full
possession until March 1, 2022
Terms & Conditions:
This is a cash or conventional loan sale, which means potential buyers must have their financial arrangements secured prior to bidding. The sale of these property is not contingent upon Buyer(s) obtaining financing. All financial arrangements are to have been made prior to bidding at the auction. By bidding, the bidder makes representation that the bidder has the present ability to pay the bid price and fulfill the Real Estate Contract.
This property will be sold by the acre, based on the legal description., with the acres understood to be “more or less”. This property will be offered at the live auction by _X_ amount of dollars per acre, times the total acres.
There will be no buyer contingencies offered or accepted for inspections, or appraisals.
Immediately upon the conclusion of the auction, the successful bidder(s) will be required to sign a real estate purchase contract and to deposit with RE Broker/Auctioneer, a nonrefundable earnest money payment of ten (10) percent of the total purchase price. Balance of the purchase price is due in certified funds at closing on or before January 20, 2022. Buyers will be granted ownership of these properties after final payment is made on the date of the closing, but in lieu of a previous oral lease, full possession to be granted on March 1, 2022.
Conveyance of marketable title will be transferred Warranty Deed, free and clear of liens but subject to easements, reservations, and exceptions of record as well as statutory rights of way and other recorded easements at the time of sale. Owners’ title insurance policy will be provided to the buyer for examination prior to the auction. Cost of title insurance policy and closing service fees will be divided equally 50% buyer & 50% seller.
These properties are to be sold AS-IS / WHERE-IS. Property is being sold by legal descriptions only. Should a property survey become necessary, it will be at the buyers’ expense. Seller(s) do not warranty or guarantee the property boundaries are accurate. Any new boundary survey will be the responsibility of the Buyer, pursuant to Nebraska statutes.
